The petitioner, Juan Chavez, appeals from the judgment of the habeas court rendered after denying his petition for certification to appeal from the denial of his petition for certification to appeal. The following facts and procedural history are relevant to our resolution of this appeal. On the basis of a misjoinder of charges and a violation of General Statutes § 53a-38a(a),[2] the court rendered judgment of only one conviction, namely, the conviction of assault in the first degree.[3] The court sentenced the petitioner to a total effective term of thirteen years imprisonment, suspended after seven years, and ten months, and three years of probation. The petitioner, through his court appointed counsel, filed a direct appeal from his judgment of conviction. In his direct appeal, the petitioner claimed that the trial court had improperly charged the jury on the theory of the same criminal conduct as charged in a count to which the petitioner had entered a plea of nolo contendere.
